(KMOV) -- The alleged abuse of eminent domain prompted new laws and now a case revolving around the right to take someone else's property is back in court.

When you think of eminent domain, the right to take someone else's property for the greater good, you usually picture dilapidated areas of a community being rebuilt, or perhaps the homes that were in the way of the I-64 expansion.

But in Clayton, the city argues that some buildings should be condemned because they are a, "blight" on the area, and should be torn down to make room for the Centene Corporation's $210 million development.

On Wednesday, attorneys for the company and the property owners presented their cases to the Missouri Court of Appeals.

This case went to the Court of Appeals when Centene purchased nearby property, then offered to buyout the owners of these businesses in the 7700 block of Forsyth.

They refused the offer, so a St. Louis County Circuit judge agreed to let Cendene use eminent domain to take the properties, and the appeal brought the issue to the Court of Appeals.

The court of appeals is expected to make a ruling within the next thirty days.

It seems likely that the loser may ask the U.S. Supreme Court to hear the case.
